1. INTRODUCTION

These Terms of Service (“Terms”) govern your access to and use of the Gardens of Vaitarna website (“Website”) and your purchase of products through the Website.

Gardens of Vaitarna (“GoV”) is a brand operated by Vaitarna Estate Private Limited (“Vaitarna Estate”, “we”, “us” or “our”).

By accessing the Website, creating an account, placing an order or otherwise using the Website, you agree to be bound by these Terms, together with any other policies or terms referred to in these Terms.

If you do not agree with these Terms, please do not use the Website or place an order through it.

2. ELIGIBILITY

You may use the Website and place orders only if you are legally capable of entering into a binding contract under applicable law.

If you are under the age of 18 years, you may use the Website only with the involvement and consent of your parent or legal guardian.

By using the Website or placing an order, you represent that the information you provide to us is accurate and that you have the legal capacity to enter a transaction.

Any product-quality or food-safety concern should be reported to us promptly in accordance with our Returns, Refunds & Cancellations Policy.

5. PRODUCT AVAILABILITY

All products displayed on the Website are subject to availability.

We reserve the right to:

  • limit the quantity of products that may be purchased;
  • discontinue a product;
  • modify product specifications or packaging;
  • restrict delivery to particular locations; or
  • decline or cancel an order where the product is unavailable or cannot reasonably be fulfilled.

Where payment has already been received for an order that we cancel, the applicable amount will be refunded.

You authorise the applicable payment service provider to process the payment for your order.

GoV does not ordinarily store complete card, banking or other sensitive payment credentials on its own systems. Payment transactions may be processed by third-party payment service providers in accordance with their applicable terms and privacy policies.

We are not responsible for delays, failures or errors attributable to a third-party payment service provider, except to the extent required under applicable law.

10. CANCELLATIONS, RETURNS AND REFUNDS

Cancellations, returns, replacements and refunds are governed by our Returns, Refunds & Cancellations Policy.

Because GoV sells food and consumable products, returns are generally not accepted after delivery except where permitted under that policy or applicable law.

Nothing in these Terms limits any consumer rights available under applicable law.

11. USER ACCOUNTS

Where the Website allows users to create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.

You agree to provide accurate and current information and to update your information when necessary.

is owned by or licensed to Vaitarna Estate Private Limited or its respective licensors and is protected by applicable intellectual property laws.

You may access and use the Website for your personal, non-commercial purposes.

You may not reproduce, modify, distribute, publish, sell, license or commercially exploit Website content without our prior written permission.

14. USER-GENERATED CONTENT

If the Website allows you to submit reviews, comments, photographs, testimonials or other content (“User Content”), you remain responsible for the content you submit.

By submitting User Content, you confirm that:

  • you have the right to submit the content;
